Abstract:
This article analyses the institution of jurisdiction agreements in private international law, focusing, first, on the persistent uncertainties surrounding their legal nature. In particular, the analysis will begin with a comparison between the substantive approach, typical of common law systems, an...d the procedural approach, characteristic of civil law jurisdictions. In light of the limitations inherent in both theories, the contribution will advocate the mixed-nature thesis of jurisdiction agreements, which is considered more suitable for capturing the dual, substantive and procedural, dimension of choice of court clauses. Subsequently, attention will be devoted to exclusive choice of court agreements, currently governed by art. 25 of Regulation (EU) n. 1215/2012 and art. 3 of the 2005 Hague Convention on Choice of Court Agreements. Specifically, by adopting a restrictive interpre tation of the aforementioned provisions, the contribution aims to define more precisely the notion of exclusivity, excluding from the category of exclusive jurisdiction agreements those clauses that depart from the model established by the above-mentioned instruments of uniform private interna tional law. Moreover, this reconstruction will shed light on the category of asymmetric jurisdiction clauses, reserving this qualification exclusively for so-called unilateral agreements, namely agree ments that are “exclusive” for one party and “non-exclusive” for the other.

Abstract:
This article examines a specific injunctive remedy: the anti suit injunction. This is a discretionary judicial order directed at a private party, intended either to prohibit the initiation of proceedings in another forum or to compel the party to cease any proceedings already commenced in that fo...rum under the threat of financial or personal sanctions. After outli ning the key judicial developments that have established the incompatibility of anti-suit injunctions with the European legal order, the analysis shifts to the impact of Brexit and the conflict with Russia on the issuance of such injunctions by courts. Within this framework, the article primarily focuses on the possibility of identifying a new legal basis for restricting the circula tion of anti-suit injunctions under the general clause of international public policy

Abstract:
The Court of justice of the European union admits the possible classification of judgment and orders of the High Court as “quasi” anti-suit injunctions when the purpose of that judgment and those orders is, at very least, to deter a party from bringing or continuing proceedings before... the courts of a member State. All these aspects are conside red, by the ECJ, in breach of the concept of public policy (Art. 34 regulation n.44/2001) For these reasons, a court of a member State may refuse to recognise and enforce a judgment of a court or tribunal of another member State on the ground that it is contrary to public policy, where that judgment impedes the continuation of proceedings pending before another court or tribunal of the former member State, in that it grants one of the parties provisional damages, the amount of which is not final and is predicated on the continuation of the proceedings.
